Ohio has a relatively employer-friendly environment when it comes to employment law. In key employment law areas, Ohio generally follows federal law. However, one unique issue employers may find in Ohio is the authority of local jurisdictions under the Ohio Constitution to enact their own ordinances affecting the workplace. Under “home rule,” cities have enacted pay transparency, ban the box, wage theft, anti-discrimination, and other workplace-related ordinances. While the Ohio General Assembly at times tries to reign in these efforts, the constitutional right to home rule makes this difficult.
